ChooseMyStay Host Agreement

This Host Agreement governs the onboarding, review, listing, promotion, booking, payment facilitation, guest coordination, settlement, and related platform services for properties listed or proposed to be listed on ChooseMyStay.
ChooseMyStay is operated by Kizhakeyil Technologies LLP, a Limited Liability Partnership registered in India, having GSTIN 32ABFFK3386H1ZB, with its principal place of business at Second Floor, Uthradam Building, Babuji Nagar RWA, Thycaud, Thiruvananthapuram, Kerala - 695036, India.
This Agreement is between Kizhakeyil Technologies LLP, operating the product and brand ChooseMyStay, referred to as "ChooseMyStay", "Platform", "we", "us", or "our", and the property owner, host, manager, operator, authorised representative, or entity accepting this Agreement or submitting a property for listing, referred to as "Host", "you", or "your".
By selecting the acceptance checkbox, entering your name, clicking "Accept Host Agreement electronically", accepting through a secure host acceptance link, submitting a property application after being asked to review this Agreement, or providing a physical signed copy that is verified by ChooseMyStay, you agree to this Agreement. Electronic acceptance is recorded as "Host Agreement accepted electronically". A physical document is treated as signed only when uploaded and verified through ChooseMyStay's authorised operations process.
1. ChooseMyStay's Role
ChooseMyStay is an online stay discovery, listing, booking facilitation, payment facilitation, guest support, and operations support platform for villas, pool villas, homestays, serviced stays, apartments, houses, group stays, family stays, and similar accommodation.
ChooseMyStay does not own, lease, operate, manage, control, insure, maintain, or physically supervise your Property unless a separate written agreement says so. You remain responsible for the Property, its legal operation, accuracy, safety, cleanliness, staff, permissions, taxes, guest readiness, and guest experience.
ChooseMyStay may assist with onboarding, listing content, internal review, ranking, promotion, guest enquiries, booking coordination, payment collection, customer support, refunds, settlement statements, dispute handling, and compliance workflows. Such assistance does not make ChooseMyStay the owner, operator, manager, employer, insurer, or guarantor of the Property.
2. Host Authority and Eligibility
You represent that you have full legal authority to list and offer the Property for guest stays. If the Property has co-owners, family owners, partners, directors, lessors, society restrictions, association rules, or third-party permissions, you confirm that you have authority to bind the relevant persons or entity.
You must provide true, current, and complete information, including identity, contact, property, ownership, authorisation, tax, location, media, safety, and compliance information requested by ChooseMyStay.
ChooseMyStay may refuse onboarding, reject an application, pause approval, suspend a listing, block publishing, disable payment collection, pause settlement, or remove a Property if information is missing, inaccurate, expired, disputed, unsafe, unlawful, or unsuitable for the Platform.
3. Onboarding, Review, and Listing Lifecycle
Submitting a host property application does not guarantee approval, listing, public visibility, booking eligibility, payment enablement, ChooseMyStay verification, or payouts.
A pending application may be reviewed by ChooseMyStay operations. Approval may create an internal property record and allow further host setup, but approval alone does not make the Property public, searchable, bookable, verified, or payment-enabled.
A Property becomes publicly visible only when all Platform requirements are satisfied, including setup completion, active listing state, eligibility checks, applicable verification checks, an accepted or verified Host Agreement, and any other operational or compliance requirements then in force.
ChooseMyStay may use internal identifiers such as application codes and property codes. These are platform/API identifiers and are not public website URLs. Public listing URLs, titles, and paths may be assigned, edited, or changed by ChooseMyStay.
4. Host Agreement Gate
ChooseMyStay may require Host Agreement acceptance before application approval, conversion, verification, payment enablement, publishing, or continued listing.
Self-onboarded hosts may accept electronically using an authenticated public host account. Ops or staff accounts cannot accept electronically for a Host. ChooseMyStay may also send a secure email, SMS, WhatsApp, or manual acceptance link. A link does not grant acceptance power by itself; the matching authenticated Host must still accept.
For non-technical Hosts, ChooseMyStay may accept a physical signed agreement only after upload and verification by authorised staff. Upload alone is not acceptance.
ChooseMyStay records acceptance evidence, including the agreement version, content hash, acceptance method, timestamp, typed name, checkbox/button wording, user/account details, IP address, user agent, and target property/application context where applicable.
5. Listing Content and Accuracy
You are responsible for the accuracy and completeness of all listing information, including property type, location, guest capacity, rooms, beds, bathrooms, amenities, pool details, accessibility, parking, kitchen access, pricing, rules, restrictions, caretaker availability, check-in/check-out times, safety information, surveillance disclosures, and cancellation terms.
You must not provide false, exaggerated, outdated, copied, AI-manipulated, misleading, or incomplete information.
ChooseMyStay may create, edit, format, translate, crop, optimise, moderate, rank, promote, pause, unpublish, or remove listing content for clarity, brand consistency, guest understanding, legal compliance, SEO, safety, quality, or operational reasons. Final factual responsibility remains with you.
6. Location and Address Privacy
ChooseMyStay may show an approximate public location before booking confirmation. Exact address, GPS coordinates, access route, caretaker contact, lockbox information, and arrival instructions may be withheld until booking confirmation, required payment, identity checks, or other booking conditions are completed.
You agree to this staged disclosure model and must not require ChooseMyStay to publish exact private location details before confirmation.
7. Booking Modes and Availability
ChooseMyStay may support request-to-book, book-now, paid hold, full payment, offline/manual confirmation, or other booking flows depending on Property readiness, verification status, payment configuration, risk checks, and Platform policy.
Book-now or online payment collection is not guaranteed. ChooseMyStay may enable, disable, downgrade, or change booking mode based on availability reliability, complaints, verification, payment readiness, fraud risk, legal risk, host responsiveness, or operational requirements.
You must keep availability accurate and immediately block dates for owner use, maintenance, private bookings, offline bookings, closures, or any unavailability. If a confirmed booking fails because of your calendar, pricing, readiness, staff, access, or off-platform commitment, you are responsible for resulting refunds, guest impact, support costs, and settlement adjustments.
8. Pricing, Fees, and Commercial Terms
Prices, discounts, guest-facing fees, host platform fees, host commission, taxes, payment charges, refundable/non-refundable rate plans, reservation fees, and settlement calculations are determined by the Platform's applicable configuration, published policy, checkout display, settlement statement, property-specific written terms, or commercial schedule.
Do not rely on any fixed commission, service fee, refund, tax, or payout rate unless it is shown in the applicable dashboard, checkout, settlement statement, signed schedule, or written commercial confirmation from ChooseMyStay.
You must not demand undisclosed payments from Guests. Optional add-ons, deposits, extra guest charges, damage claims, overstay charges, food, chef, BBQ, campfire, pool, decoration, or similar charges must be disclosed and approved before they are charged, unless they arise from Guest misconduct or post-booking Guest requests.
9. Payments, Taxes, and Settlement
You authorise ChooseMyStay and its payment partners to collect booking payments, advance payments, full payments, reservation fees, platform fees, taxes, deposits, add-ons, cancellation amounts, damage amounts, and other applicable charges connected with Platform bookings.
All payments and settlements are subject to payment success, gateway confirmation, fraud checks, chargebacks, refunds, cancellation rules, tax treatment, payment provider rules, booking status, guest disputes, KYC/tax documentation, compliance checks, and legal requirements.
ChooseMyStay may deduct or adjust host platform fees, GST on platform fees, applicable TDS/TCS/withholding, refunds, chargebacks, payment reversals, penalties, guest compensation, damage adjustments, and other amounts payable under this Agreement.
You are responsible for your own tax, GST, income tax, property tax, local levy, guest registration, invoice, filing, and statutory obligations. ChooseMyStay may collect, deduct, withhold, report, invoice, or remit amounts where required by applicable law or platform structure, including where ChooseMyStay is treated as an e-commerce operator or payment/collection facilitator.
10. Cancellation, Refunds, and Guest Issues
The cancellation and refund policy shown to the Guest at checkout, booking confirmation, invoice, or official communication governs that booking. ChooseMyStay may maintain cancellation policies through published legal documents or platform configuration, and confirmed bookings may retain a policy snapshot.
You must honour the applicable cancellation policy. If a refund, cancellation, rebooking, credit, support cost, or guest compensation is caused by Host fault, listing mismatch, unavailability, refusal of check-in, unsafe conditions, undisclosed restriction, serious cleanliness issue, unavailable essential amenity, or other stay issue, ChooseMyStay may reduce, withhold, or recover amounts from current or future settlements.
You must cooperate promptly with investigations and provide accurate evidence, including photos, videos, bills, staff statements, access logs, communications, or other relevant records.
11. Property Readiness and Standards
You must ensure the Property is clean, safe, accessible, lawful, and guest-ready before check-in. Promised amenities, power, water, locks, appliances, bathrooms, kitchen access, pool, parking, Wi-Fi, linen, towels, and staff/caretaker arrangements must be available as represented.
For pool properties, you must maintain reasonable hygiene, disclose pool rules and restrictions, manage child safety risks, provide warnings where appropriate, and follow applicable safety obligations.
You must not accept bookings for a Property that is unsafe, inaccessible, under major maintenance, materially different from the listing, legally restricted, or not ready for Guests.
12. Staff, Caretakers, and On-Site Conduct
You are responsible for caretakers, cleaners, cooks, security staff, vendors, agents, family members, representatives, and any person involved in operating or servicing the Property.
They must behave professionally, respect Guest privacy, avoid harassment or discrimination, avoid undisclosed charges, follow safety rules, and cooperate with ChooseMyStay support. Their misconduct, negligence, unlawful conduct, privacy breach, overcharging, refusal of service, theft, violence, or guest mistreatment is treated as your responsibility.
13. Safety, Privacy, CCTV, and Guest Records
You must disclose CCTV, recording devices, shared areas, restricted areas, staff access areas, caretaker presence, and any surveillance before booking. No camera or recording device may be placed in bedrooms, bathrooms, changing areas, or other private areas where Guests reasonably expect privacy.
You are responsible for legally required guest registers, ID checks, police reporting, Form C/Form B, foreign guest records, local authority requirements, and similar compliance obligations where applicable.
Guest personal information may be used only for booking fulfilment, check-in, safety, legal compliance, stay support, and dispute handling. You must protect Guest data, restrict access, avoid unnecessary retention, and immediately notify ChooseMyStay of any leak, misuse, unauthorised access, or suspected breach.
14. House Rules and Non-Discrimination
You may set reasonable house rules for capacity, visitors, parties, smoking, alcohol, pets, pool use, noise, parking, kitchen access, check-in/check-out, deposits, damage, restricted areas, and safety. Rules must be disclosed before booking confirmation unless required by law or urgent safety needs.
You must not impose discriminatory, unlawful, hidden, arbitrary, misleading, or unreasonable rules. You must not discriminate based on religion, caste, race, ethnicity, gender, sex, sexual orientation, disability, nationality, language, marital status, family status, age, food preference, or any protected or sensitive characteristic under applicable law.
15. Off-Platform Diversion
You must not use ChooseMyStay leads, Guests, enquiries, booking data, contact details, platform messages, or support processes to divert Guests to direct/off-platform bookings for the purpose of avoiding platform fees, commission, taxes, cancellation rules, or platform controls.
You must not ask Guests to cancel and book directly, send direct payment details before permitted, offer direct discounts to bypass the Platform, collect undisclosed payments, move bookings to another channel without approval, or use Guest contact details for unrelated marketing.
For Guests or leads introduced by ChooseMyStay, ChooseMyStay may treat related bookings for the same Property or Host-managed property as Platform-generated where the booking resulted from Platform information, unless you can show independent acquisition.
16. Content Licence and Marketing
You confirm that you own or have rights to all photos, videos, descriptions, logos, floor plans, documents, and other content provided for the Property.
You grant ChooseMyStay a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, edit, crop, resize, translate, publish, display, distribute, advertise, and create derivative works from that content for listing, SEO, social media, campaigns, guest communication, support, internal review, audit, legal compliance, and Platform promotion.
ChooseMyStay may continue retaining and using content needed for completed bookings, disputes, tax, accounting, audit, fraud prevention, legal compliance, and historical platform records.
17. Reviews and Quality Controls
Guests may submit reviews, ratings, complaints, photos, videos, and feedback. ChooseMyStay may publish, moderate, remove, restrict, or use reviews and feedback according to Platform policy.
You must not manipulate reviews, post fake reviews, threaten Guests, offer incentives for positive reviews, or discourage genuine feedback.
ChooseMyStay may use reviews, complaints, response history, cancellation history, and quality signals for ranking, badges, verification, suspension, coaching, refunds, and listing decisions.
18. Insurance and Compliance
You are responsible for appropriate insurance, permits, licences, registrations, fire/safety compliance, pool safety, food/service compliance, labour/staff compliance, tax compliance, guest records, local body rules, society/association rules, noise rules, alcohol/event rules, environmental rules, and all laws applicable to offering the Property for guest stays.
ChooseMyStay does not provide insurance for you unless a separate written agreement says so. You should obtain insurance suitable for short-term guest stays, including public liability where appropriate.
19. Suspension, Removal, and Termination
ChooseMyStay may pause, hide, demote, suspend, unpublish, remove, or terminate a Listing or Host account if there is breach, missing documentation, legal risk, safety risk, guest complaint, suspected fraud, off-platform diversion, data misuse, repeated cancellation, inaccurate availability, misleading price, ownership dispute, poor quality, or operational risk.
You may request delisting by written notice, but delisting does not affect confirmed bookings, refunds, settlement adjustments, tax obligations, guest support, disputes, data protection duties, or amounts payable to ChooseMyStay.
After termination, you must honour confirmed bookings unless ChooseMyStay approves cancellation, relocation, refund, or another resolution.
20. Indemnity and Liability
You agree to indemnify and hold harmless ChooseMyStay, Kizhakeyil Technologies LLP, its partners, employees, contractors, vendors, representatives, and affiliates from claims, losses, penalties, interest, liabilities, notices, proceedings, costs, and expenses arising from your Property, listing inaccuracy, lack of authority, safety issue, guest injury, illness, death, theft, damage, cancellation, tax non-compliance, staff misconduct, privacy breach, off-platform diversion, legal violation, third-party claim, or breach of this Agreement.
To the maximum extent permitted by law, ChooseMyStay is not liable for indirect, incidental, special, punitive, exemplary, or consequential loss, including loss of profit, reputation, opportunity, business, or emotional distress. ChooseMyStay is not responsible for payment gateway failure, bank delay, telecom failure, map error, cloud outage, third-party API failure, Guest misconduct, Host staff misconduct, government action, force majeure, or events outside reasonable control.
Where ChooseMyStay is found liable to you, its aggregate liability is limited to the host platform fee or commission received by ChooseMyStay from the specific booking giving rise to the claim, unless a higher amount is mandatorily required by law.
21. Confidentiality
You must keep confidential non-public information received from ChooseMyStay, including pricing strategies, commercial terms, guest data, booking data, settlement details, platform processes, internal documents, software, staff contacts, marketing plans, support methods, and operational procedures.
This obligation survives termination.
22. Notices and Changes
ChooseMyStay may send notices by email, dashboard notification, WhatsApp, SMS, phone, courier, registered post, or other contact details provided by you.

ChooseMyStay may update this Agreement from time to time. Material changes may be notified by email, dashboard, WhatsApp, or platform notice. Continued listing, use of host tools, acceptance of bookings, or electronic acceptance of a new version will apply as stated in the updated terms.
23. Governing Law and Disputes
This Agreement is governed by the laws of India. Subject to arbitration and interim relief rights, courts at Thiruvananthapuram, Kerala have jurisdiction.
The Parties will first try to resolve disputes through good-faith discussion. If unresolved within 30 days of written notice, the dispute may be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a sole arbitrator appointed by mutual agreement or in accordance with law. The seat and venue of arbitration will be Thiruvananthapuram, Kerala. The language will be English.
Nothing prevents ChooseMyStay from seeking urgent court relief for guest data misuse, off-platform diversion, intellectual property misuse, fraud, safety risk, non-payment, or other urgent harm.
24. Survival
Clauses relating to payments, settlements, taxes, refunds, chargebacks, guest data, confidentiality, content licence, audit records, indemnity, limitation of liability, disputes, and amounts payable survive termination.
25. Acceptance Confirmation
By accepting this Agreement, you confirm that:
- you have read and understood this Agreement;
- you have authority to list and offer the Property;
- information and documents provided by you are true and complete;
- you will honour confirmed bookings;
- you accept the applicable commercial, settlement, cancellation, tax, and platform terms;
- you will comply with applicable law and local requirements;
- you will protect Guest personal information;
- you understand ChooseMyStay is a platform and facilitator, not the owner or operator of the Property.

Schedule C - Operational Standards
The Host must keep the Property clean, safe, legally available, accurately listed, calendar-updated, guest-ready, privacy-compliant, staff-supervised, and ready to honour confirmed bookings. The Host must promptly report closures, maintenance, legal issues, safety issues, ownership changes, caretaker changes, access issues, amenity failures, and any condition affecting guest experience.
